I live in Oklahoma, my partner and I have just parted way’s after 12 years.?
Question by : I live in Oklahoma, my partner and I have just parted way’s after 12 years.?
After 12 years we have parted way’s . What’s crazy is that we just had a beautiful baby girl 9 months ago yesterday.I can’t believe after all we’ve been through together, it’s ended now. As much as I wish that we were not over , the fact that he’s involved with another woman , pretty much say’s he’s not going to have a change of heart. However my question is, since we were together for 12 yrs. are we considered to be common law married ? If so, what do I do ? Are there any legal forms or divorce proceedings that need to be tended to ? Child support is already coming out of his check through DHS. Do I need to have him served with a divorce degree document ?

In the state of Oklahoma you have to live with the person for 6 month to be considered common law. Yes you will have to go to your local court house and file.

I’ve already filed a Fee waiver with the court… do I have to file a new one everytime something is filed? my case involves domestic violence and I havn’t seen my son in a year and a half. My wifes lawyer keeps screwing me around, no answers/respones. I decided to fill out an “order to show cause” because im frustrated and sad. Is this the correct form to ask the judge to change our custody order/ or to let me start seeing my son? please email me or help me…

what can happen when you get a divorce?
Question by : what can happen when you get a divorce?
like what are the legal agreements my mom has no job and 3 kids two are my step dads ( the one shes getting divorced form ) what are her chances given the fact she hasnt worked in 8 years and he has a great job that pays 100,000 a year pretty much and only two of the kids are his what do you think her chances are ???

Her chances of what? If she has primary custody of the kids, the respective fathers will pay child support for them. She may get some spousal support for a short time, but these days courts require each parent to get a job, work on getting a job, or go to school to be able to get a job. For an 8-year marriage, she won’t get spousal support forever so she will have to find a job.

Legally, your boss never should have given your ex-wife your W2 form, if he knew the two of you were divorced, and/or he was aware that any former relationship between you and your wife, had changed.

Can I represent my mother in a divorce?
Question by : Can I represent my mother in a divorce?
My dead beat father has been threatening my mum to willingly sign divorce papers and my mum refused on the premises that we live in our grandparents house on my father’s side and they warned us that if my parents got a divorce they’d kick us out. I’m not sure if they really meant it, but my mother is real worried about it so she is refusing to sign anything. So he hired a attorney and got the paper works for a divorce.
Hiring an attorney is expensive, I would like for us to represent ourselves but the problem is my mum’s English isn’t that great when it ventures into the legal system. Both my parents have limited knowledge in English and my dad has hired an attorney at $ 200 an hour to help him. I’ve read that in order to practice law you need to be licensed, does that extend to family courts as well? We live in California.
I know California courts offer short seminars on divorces/self-representation but that wouldn’t do much for us if I couldn’t represent her. In any case I’ll be heavily involved as she has poor English, I’ll be the one to translate between her and our attorney. Are there any lawyers that do pro bono in northern California, more specifically Contra Costa county? I have sites for them but I’m appealing to anyone who has personal experiences in this field. Thanks in advance.
Quick question, is it weird that my dad in his legal forms chose to be the legal guardian of my brother yet he designates my mum to have physical custody of him? There are three boxes for that question, petitioner, responder, joint, so it struck me as odd the way the forms we’re filled. I think he’s hired a cr@ppy lawyer, misspelled our home address, his work place, his occupation.
