PostHeaderIcon Q&A: Have to see the judge for divorce?

Question by : Have to see the judge for divorce?
My wife and I filed for a no fault divorce – no property or kids and was under 5 years . We filed and they said it could take a bout a month but once the judge looked through it we would get the official papers in the mail. Now it says we both have to show up next friday in front of the judge. What does he want?

He probably just wants to make sure that it’s what you both really want. Sometimes when one of the spouses doesn’t want a divorce, the judge mandates counseling for a period of time. It all depends. If you both want it, I wouldn’t worry about it.

Well, it might be wise to consult with an attorney – and see how you can get the money moved from joint accounts before he takes flight

Honestly – he could take flight whether you have an attorney or not

Don’t tell him you are going

PostHeaderIcon Are there states that take into consideration who was at fault in a divorce?

Question by .: Are there states that take into consideration who was at fault in a divorce?
I live in California. Out here we are a community property & a no fault state…so you can be a billionare, marry someone, they cheat on you with the limo driver, and you can walk away with half their stuff (this is actually a true story).

Are there some states that aren’t community property & they do take into consideration who caused the marriage to end? If so, what happens when assets are divided up?

NY requires fault but no one in their right mind would chose the NY divorce process.

There is not easy way out, but no fault is where you don’t have to have a reason .

You can buy kits to do your own divorce ,basic fairly easy. If you have nothing to split or money issues or children ,otherwise I say get a lawyer !
