PostHeaderIcon Q&A: My wife and I are getting a divorce and how can me and my daughter make it through this?

Question by Chris: My wife and I are getting a divorce and how can me and my daughter make it through this?
Friday my wife told me she wants a divorce and now she says she wants to take our daughter with her. My daughter says she wants to stay with me because we are like best friends. She is 16 so should she be able to decide for herself or should I let my wife take her with her? And what can we do to get ourselves through this? I don’t want a divorce but my wife says she has made up her mind and that I can’t change it. What should we do now?

It is pretty simple…go file for divorce and full custody.

At 16 the court will allow the child to decide.

Do not sit around waiting to defend yourself.

    Be proactive!

    Best wishes

PostHeaderIcon Q&A: Can my daughter get a divorce in Texas if she is pregnant but legally separated. Her husband not the father.?

Question by bnorth8249: Can my daughter get a divorce in Texas if she is pregnant but legally separated. Her husband not the father.?
Her husband left her over one year ago and moved to South Carolina. Legal separation papers were filed there. There was a child custody issue. She now has custody of all her children.. However she has not been able to afford a divorce. Now she is pregnant by another man. She was told that since she is still legally married. Her ex is considered the legal father and she cannot obtain a divorce in the state of Texas since she is pregnant. Is this true? Her ex is still in SC.

PostHeaderIcon Court Papers Served, Autistic Daughter Received, Legal?

Question by Beach Girl: Court Papers Served, Autistic Daughter Received, Legal?
My boyfriend is going through a nasty divorce.

When we were not home, my teen son and his 12 year old autistic sister were home.

There was a knock on the door, the teen son was in his room and didn’t hear it, the 12 year old autistic daughter did and she answered the door *(a big no-no, she knows that now).

The person who knocked on the door was serving the divorce papers for my boyfriend but since we were not home, the autistic daughter received them and hid them because she thought they were from her school and didn’t want me to see them.

The next week, we got a letter in the mail saying that my boyfriend missed the court date, but he wasn’t aware of it because my daughter hid the paperwork.

Was he “improperly served” since my daughter, who received the paperwork, is under the age of 14 and is mentally disabled?

Also, when he called his soon-to-be ex wife’s lawyer, the lawyer cussed him out. Can the lawyer get into trouble for this?

Those are great questions and probably require an attorney. As to the cussing out – I doubt it but I would still report him to the Bar.

PostHeaderIcon Should my daughter hire a lawyer to file for divorce and child custody, or can she do it herself. He’s cheatin

Question by gospelpin1: Should my daughter hire a lawyer to file for divorce and child custody, or can she do it herself. He’s cheatin
Husband is cheating with a co-worker, but threatens to take their son over the state lines, if she leaves him. Basically using her to pay his way through school. She wants to file for legal separation papers and divorce papers along with custody papers, but does not have the money to do so. Not even enough money to move out on her own. She and her son will have to move in with a girlfriend or her family. How can this be done cheaply, but right?

ALWAYS hire a lawyer. They know a lot more about the legal system and law than your daugher would. No lawyers are never cheap! She will have to pay.
