A friend of mine came here some years ago and married someone so they can get their papers. Now my friend wants to divorce their spouse because they never intended to be with this person for an extended period of time. However the spouse does not want to divorce and is willing to cause trouble and problems for other people. (To add more to the mix, there is a question of if a certain child belongs to my friend.) How do I help? What advice do I offer without getting my friend deported, but allowing them to get the divorce they want??

This sounds fishy. When you marry a US citizen, you receive a conditional green card that’s good for two years. After two years, if the couple is still married, the condition is removed and the green card becomes permanent. As long as all of the relevant paperwork was filled out, there should be no problem filing for divorce, even if the other person doesn’t want one.
But your friend committed fraud on the US Government by coming here and marrying under false pretenses. He should absolutely be deported.

My fiancee is trying to divorce his wife whom he has been seperated from for two years now. We got together AFTER she left and they were legally seperated. However, she wants to add on the divorce papers the reason for divorce was adultery, which is false. She had a cell phone plan in HER name that he gave her money for every month after she left. When she finally turned his phone off she claimed he owed her $ 300.00 which included fees for the early termination. She was also asking for money for her student college loans which she took out in, once again, HER name only while they were married. They were married from july 142006-july 15 2007, just barely a year and one day.
She says that she wants a lawyer and that she’s going to ask for these reparations before she agrees on the divorce. I feel she is doing this as a stall tactic to anger the two of us and keep us from going through with our marriage. Either way, it needs to be taken care of and my fiancee claims that if she does go to a lawyer that he/she will get creative and he will end up having to pay the charges for her lawyer and his potential lawyer as well.
For people who were only married a year, I don’t think a lawyer would even want to take the case (for anything other than the money) as I believe it would never make it to court.
Any advice is welcome and appreciated as I want to get past this and avoid any unpleasantness this scorned female may try to cause. Thanks

Only a lawyer can give you legal advice, people on this site can’t. Even if they are lawyers.
Anyway, he should proceed with the divorce, if she gets a lawyer, let him get one too. If her claims are frivolous then her lawyer will tell her this and probably won’t pursue them. If they aren’t, your fiance’s lawyer will deal with them. I’m not sure where you live – most places don’t even have fault divorce any more – but where I live they rarely allocate all the costs to one party either.
BTW, it’s fiance if he’s a man.

you have to go to the court house that the divorce was filed at you can ask them to fax it to you

I got a green card by my husband’s working base about a year ago. I want to divorce now, but some people say that I can’t divorce within 2 years after I get a green card. I think so, if I would get it by marriage base. Some people say I can divorce next day after I get a real green card, not a temporary one.
We have been separated for 6 years already. When my husband applyed a green card from the restaurant he is working for, our lawyer told us to stay married until we got a green card and we agreed. I got my husband’s last name on my green card, so I was trying to change to my last name since I use my last name for all my credit card, drivers licence, etc.. But immigration told me that I have to bring a divorce paper to change my last name. I want to know if I can divorce or not.

I would like to know if can someone divorce someone who refuses to sign the divorce papers? What kind of divorce is that, and what are the grounds for that type of divorce?

A divorce can be filed by one person. If the other person refuses to sign it most state have laws governing a time limit. A contested divorce will only sit in limbo for a certain time before the judge will grant it. Most states are 1-2 years. Our state at one time said 12 months from the last date the relationship was consummated but it may have changed.
